I have a basic management package that I developed and which is currently being used by just over 20 physicians in Ontario, Canada. From time to time, I get asked if I can implement an EMR solution to go along with the practice management software. I was initially tempted to start developing an EMR package myself but after seeing OpenVista I think it would be a perfect product to offer my customers in the event they are looking to implement an EMR.
I reviewed the licenses for the openVista CIS and OpenVista Server products but I would like to clarify/confirm a few things before I dive into OpenVista...

Since OpenVista is licensed under the AGPL, you can do all of these things. However, you must tell your customers (even if they are using OpenVista as a hosted service) that OpenVista is open source software licensed under the AGPL, and that they can get the source code if they want it. Also, if you enhance OpenVista, you must make your enhancements available to your customers under the AGPL. I think I probably need to make the standard disclaimer that I am not a lawyer, and just in case, I should probably say that my responses above do not constitue explicit permission for you to do these things, but rather are my understanding of the AGPL license which we make OpenVista available under. Since the AGPL is a well-understood open source license, I'd encourage you to read more about it online and get a real lawyer to review your options.
Finally, I'll mention that while you are free to use OpenVista under the AGPL without any formal help from Medsphere, it may be advantageous for you to partner with Medsphere if you're planning on rolling OpenVista out to your customers.
Not speaking on behalf of medsphere, but as someone with some general familiarity with GPL licensing:
1. No, OpenVista Server and CIS are licensed under the AGPL, which gives you the right to freely run & use the software for any purpose.
2. Yes, you can't restrict your customer's access to the software or source code, but you may certainly charge for implementation or any associated services. You can even charge them for supplying them with a copy of the software.

5. Yes, the AGPL gives you that right, provided that the modified source code is made available to the customer, and to anyone else that requests it.

Based on the responses I now feel comfortable enough to take the time to thoroughly evaluate the product to see how much (if any) modifications will be required for the Canadian market. I will also be sure to run the AGPL license by a lawyer as suggested by Jonathan, but this looks pretty much perfect for my needs.
I will only be charging for installation and training and, for those customers that want it, support and hosting. I will be sure to let them know that they "own" their copy of the product (object and source) and are free to support it themselves, host it themselves or contract another OpenVista service provider for support. I actually think this will be a great source of comfort for them since they won't feel "tied in" with just one provider. In other words, if they're not happy with my service thay can use another provider for support without having to change the product.
Also, I'd be happy to contribute any modifications I have to make to support the Canadian market (if any).
